KUALA LUMPUR — The late Tun Daim Zainuddin would have wanted charges brought against him by the Malaysian Anti-Corruption Commission (MACC) to proceed to trial to their conclusion, his widow Toh Puan Na’imah Abdul Khalid said.
As such, there is no need for the Attorney-General and MACC Chief Commission Tan Sri Azam Baki to “review the ongoing prosecution” on Daim’s failure to declare his assets to the anti-graft agency, she said in a statement today.
“I state categorically on behalf of Daim, that it was his wish that the pending charge against him be proceeded with in court until conclusion, whatever happens to him.
“Daim looked forward to his day in court and had no doubt that he would be finally acquitted,” Na’imah said.
This was because the family held “from the beginning” that MACC’s had conducted a “so-called investigation” which was part of a “frivolous, malicious and politically motivated action against Daim”, she added.
“That it is baseless is clear from the fact that neither the Prime Minister who instigated the probe nor the MACC chief have been able to say, until today, what offence Daim is alleged to have committed. They cannot say what offence, because there is no such offence.
“In short, there is no need for the AG or MACC Chief to review, discontinue or withdraw the prosecution against Daim. We do not seek it,” Na’imah said.
She also said she had instructed her lawyers to write to the Attorney-General to inform him of this matter, while the Kuala Lumpur Sessions Court would be likewise notified.
Daim passed away on November 13 at the age of 86.
Following his death, Attorney General Datuk Mohd Dusuki Mokhtar said that the charges against the late Daim would be reviewed.
On January 29, Daim pleaded not guilty in court to charges of failing to comply with a notice by not declaring 71 of his assets as required under the Malaysian Anti-Corruption Commission Act (MACC Act).
The case is scheduled to be mentioned in the Sessions Court tomorrow.
Na’imah said that she had instructed her lawyers to write to the Attorney General to inform him of their decision to continue to full trial. – November 19, 2024
