High court rejects Azizi’s interim injunction to stop EC from setting date for Nenggiri by-election

Judge ruled that the EC cannot be denied from carrying out its constitutional duty

KUALA LUMPUR – The high court here has rejected an interim injunction application filed by former Nenggiri assemblyman Mohd Azizi Abu Naim to stop the Election Commission (EC) from setting dates related to the by-election for the Kelantan seat.

Judicial commissioner Roz Mawar Rozain made the ruling after nearly three hours of hearing submissions this afternoon, saying the EC cannot be denied from carrying out its constitutional duty.

She added that Azizi is still able to be a candidate in the by-election. 

The court also ordered Azizi to pay costs of RM7,000 to each defendant – Muhyiddin, Hamzah, Amar, and the EC, before setting August 28 to hear the injunction application.

The EC is scheduled to meet tomorrow to discuss preparations for the Nenggiri by-election after the Kelantan speaker vacated the seat. 

This comes after Bersatu stripped Azizi of his membership, following his declaration of support for Prime Minister Datuk Seri Anwar Ibrahim.

Azizi, who is also Gua Musang MP, also sought to nullify Kelantan Speaker Datuk Mohd Amar Abdullah’s decision to vacate his state seat.

According to the originating summons dated June 24 sighted by Scoop, Azizi named Bersatu president Tan Sri Muhyiddin Yassin, party secretary-general Datuk Seri Hamzah Zainudin and Amar as defendants. 

Besides Azizi, representatives stripped of Bersatu membership are Datuk Syed Abu Hussin Hafiz Syed Abdul Fasal (Bukit Gantang MP), Zahari Kechik (Jeli MP), Datuk Iskandar Dzulkarnain Abdul Khalid (Kuala Kangsar MP), Datuk Suhaili Abdul Rahman (Labuan MP), and Datuk Dr Zulkafperi Hanafi (Tg Karang MP).
