KLANG — The magistrates’ court, here, has sentenced a 39-year-old man to two months in jail after pleading guilty to assaulting a food delivery rider recently.
Magistrate Siti Zubaidah Mahat also sentenced Faizul Nazri with RM2,000 fine or two months jail term if he failed to pay the amount.
This comes after Faizul pleaded guilty to intentionally causing harm to 24-year-old Fakrurazzi Danial Fabilaf to a point that the victim’s jaw was fractured.
The offence took place at the roadside in front of Jalan Langat-Klang traffic lights, headed towards Klang, here, around 7.15pm on October 1.
Siti Zubaidah also reprimanded Faizul for his actions, advising him to learn from his mistake and to not deliberately act upon his feelings, in a show of self-grandiosity.
“The victim had only made a minor mistake. Even that, you wanted to beat him up for it, which led you to end up here (in court),” she said.
Faizul’s charge was framed under Section 325 of the Penal Code which carries seven years maximum jail term, and fine, if found guilty.
Earlier, Faizul’s lawyer Nicholas Cheoh pleaded for the court to grant a minimal prison and fine sentence, as the accused’s wife is seven months pregnant with their first child.
He said that the victim, in the case, had pointed a middle finger to the accused which caused him to lose judgement and acted deliberately.
“The accused also pleaded for a minimal prison sentence as he would want to be by his wife’s side when she gives birth,” said the lawyer. However, the deputy public prosecutor called on the court to award a stiffer sentence to the accused.
“A video of the incident had gone viral on social media, with several witnesses saying that the accused had acted mercilessly towards the victim.
“The victim in this case had suffered a fracture to his jawbone. The reasons presented by the defence cannot justify the violent act by the accused.
“Therefore, I am asking for a befitting punishment, not only to teach the accused a lesson but also for it to be a warning to the public,” she said.
Recently, a video featuring Faizul and the victim had made rounds on social media where the victim had claimed he was held up by a Proton Saga, with three men in it.
Klang Selatan police chief Cha Hoong Fong was previously reported to have said that the victim, who rode a motorcycle had honked to the Proton Saga for reckless driving that had almost hit the former.
Cha said the victim was strangled, punched in the face, kicked in the stomach and his legs before members of the public intervened to prevent the assault from continuing further. – October 5, 2023
