Australian Supreme Court allows woman to harvest dead husband’s sperm

62-year-old who tragically lost two adult children persuades court to allow retrieval, expressing desire for another child prior to his untimely death

KUALA LUMPUR – A 62-year-old woman who lost two adult children manages to convince the Supreme Court of Western Australia to allow her to harvest the sperm of her dead husband.

She said they were thinking of having another child before he died, seeing that their 31-year-old son was killed in a car accident in 2019, according to legal documents released today.

The woman, who cannot be named for legal reasons, also lost her daughter in 2013 when the 29-year-old drowned during a fishing trip.

Prior to her husband’s death, the couple had looked into whether it was viable to use his sperm to impregnate a surrogate.

After the husband died at home on December 17, the woman had to seek a court order to retrieve his sperm from the hospital.

Although judge Fiona Seaward ruled on December 21 that the sperm could be harvested and stored, she ruled that separate orders would be needed for it to be used for fertilisation.

In a separate case, an Australian woman was granted permission in June last year to retrieve sperm from her 29-year-old husband. He died after ripping an artery on a broken windowpane. – January 3, 2024
