KOTA KINABALU – The Sabah Legislative Assembly today approved a motion to amend the Shariah Courts Enactment 2004 to strengthen and streamline the management of inheritance in the state.
Sabah Science, Technology and Innovation Minister Datuk Mohd Arifin Mohd Arif when tabling the motion said the amendments involved three clauses with Clause 1 containing the short title and the date of coming into operation of the proposed enactment.
Clause 2 seeks to provide a clear provision on the jurisdiction of the shariah court to hear and decide on any matter relating to the succession of estate.
Clause 3 seeks to increase the civil jurisdiction for the shariah subordinate court from RM100,000 to RM300,000.
“The shariah court is also in an effort to formulate rules and recommendations so that the inheritance of Muslims is managed in a more orderly manner. Therefore this matter (amendments to the enactment) will strengthen the draft proposal that will be submitted,” he said. – November 30, 2023
