KUALA LUMPUR – The Nhaveen Action & Investigation League (NAIL) activist group has vowed to take action in the form of civil lawsuits and reports, following the acquittal of the five individuals accused of murdering 18-year-old T. Nhaveen in 2017.
Its chairman, activist Arun Dorasamy, said the team will be instituting a “robust” civil suit against the police, several unnamed officers, Penang General Hospital, and several medical officers and those from the Forensic Department.
He also said that Nhaveen’s mother, Shanthi Dorairaj, will also be filing a report with the Malaysian Anti-Corruption Commission (MACC) against several unnamed individuals and departments.
This followed alleged discrepancies with the post-mortem forensic report and the chronology of events that took place during the early hours of the incident, he added.
“The MACC report will be filed sometime next week, and we are expecting the civil suit to be filed by mid- or the third week of October,” he said when contacted by Scoop.
Arun also said the group will follow up on their integrity report against two Timur Laut district police officers, which was filed in 2021.
In a Facebook livestream, Arun said that instituting the civil suit was important, as it could bring to light important witnesses who could have testified in the case.
Five individuals – S. Gopinaath, 30; J. Ragesuthan, 22; S. Gokulan, 22; and two others who were underage at the time of the offence – were accused of murdering Nhaveen at a park on Jalan Bunga Raya between 11pm and midnight on June 9, 2017.
Nhaveen sustained burns on his back, injuries indicating sodomy, as well as internal bleeding in his abdomen and head. He was subsequently pronounced brain dead due to the injuries and passed away on June 12, 2017.
Earlier today, Penang High Court Judge Mohd Radzi Abdul Hamid, in acquitting the five individuals, cited “major flaws” in the prosecution’s case against the accused, which led to a failure to prove a prima facie case.
Following the acquittal, Nhaveen’s mother took to Facebook to express her disappointment as she had sought justice for her son. – October 3, 2023
