Indira Gandhi to appeal RM100 mil suit loss against police, govt

Lawyer expresses her client's disappointment and determination to seek justice following dismissal of her suit today

KUALA LUMPUR – M. Indira Gandhi, a 49-year-old single mother who just lost her RM100 million civil suit against the police and three others, will appeal the high court decision.

This was confirmed by Indira’s lawyer, Pavithra Loganathan, after the proceedings, who said her client was “extremely disappointed and intends to appeal”.

Indira Gandhi Action Team chairman Arun Dorasamy told Scoop that the mother of three was unable to attend today’s proceedings as she was unwell.

“I just spoke to Indira. Of course, she is very sad. (But) we accept the court’s decision. Almost immediately, she instructed the legal team to file an appeal, as she wants answers and justice.

“Her youngest daughter (who was allegedly abducted by her ex-husband) is nearly 15 years old this year. Of course, we’d like to believe that she is still alive.

“Indira was very hopeful, and all the court battles that we’ve been fighting since 2014, almost 10 years, were for only one reason. We just wanted Indira’s youngest daughter (Prasana Diksa) back.

“Nevertheless, the fight does not end here. We will continue looking for Indira’s daughter until she is back in her mother’s arms.”

He added that once Indira’s youngest daughter is returned to her, all court cases she has filed to find her will be dropped.

High court judge Datuk Ahmad Raja Mohzanuddin Shah Raja Mohzan today dismissed Indira’s RM100 million suit filed against the defendants on the grounds that he found the police and former inspector-general of police Tan Sri Abdul Hamid Bador did not commit any tort of nonfeasance.

He also said the court is in no position to second guess the manner in which the police conducted their investigation in this case.

Appearing for the police, Hamid, the Home Ministry, and the government today were senior federal counsel Zetty Zurina Kamaruddin and federal counsel Safiyyah Omar.

In her suit that was filed on October 28, 2020, Indira claimed that the defendants had been negligent and had engaged in misconduct by failing to take the necessary steps to apprehend her former husband.

She also described her anxiety stemming from constant worry about her daughter’s safety and well-being, and she seeks general, exemplary and aggravated damages from all damages.

Her ex-husband, known as Muhammad Ridhuan Abdullah after his conversion to Islam, allegedly abducted her youngest daughter when she was just 11 months old in 2009. – June 28, 2024
